COURT HEARING FOR NORTH ANNA WATER CASE ON THURSDAY

On Thursday morning, December 18th, the Blue Ridge Environmental Defense League’s appeal of the Dominion-Virginia Power North Anna permit will be argued in Richmond Circuit Court. Attorney for the League Robert Wise will show that the state permit for cooling water discharges into Lake Anna violates state and federal law.

The proceeding will begin at 8:00 AM in Circuit Court of the City of Richmond at 400 North 9th Street. Judge Margaret Spencer will preside.

The Blue Ridge Environmental Defense League filed its original Petition for Appeal in Circuit Court on December 28, 2007 pursuant to Virginia Code §§ 62.1-44.29 and 2.2-4026 and Rule 2A:4 of the Rules of the Supreme Court of Virginia.

The League seeks judicial review of the decision by the Virginia State Water Control Board to re-issue Virginia Pollution Discharge Elimination System Permit No. VA0052451 for North Anna Units 1 and 2 operated by Dominion Virginia Power. The State Water Pollution Control Board issued the permit in October 2007 in violation of the federal Clean Water Act and state statutes.
